According to the Income Tax Act and DPIIT (Department for Promotion of Industry and Internal Trade), a start-up can be a Private Limited Company, LLP, or a Registered Partnership Firm involved in innovation, development, deployment, or commercialization of new products or services.

Step 1: Incorporate Your Entity
Register your business as a Private Limited Company, LLP, or Partnership Firm through MCA (Ministry of Corporate Affairs).
Step 2: Register under Start-up India Scheme
Create an account on the Start-up India portal and apply for recognition by uploading necessary documents in PDF format.
Step 3: Self-Certify Your Eligibility
You must confirm that:
Your entity is registered in India
Business is less than 10 years old
Turnover is under ₹100 crores
Business model is innovative or improves existing solutions
Not a result of business reconstruction
Step 4: DPIIT Recognition
Upon successful document verification, you’ll receive a Start-up Recognition Certificate and a unique identification number.
Step 5: Apply for Tax Exemption (Optional)
To avail 3-year tax holiday, apply for approval from the Inter-Ministerial Board (IMB) through the same portal.
